By using homeguildutah.org you agree to these terms. If you do not agree, please do not use the site.

Use of the site

  • You may use the site to learn about Home Guild Utah, request a referral to a member business, or inquire about membership.
  • You may not use the site to send unsolicited commercial messages, scrape content, or interfere with its operation.

Referrals

Referrals connect you with independent member businesses. Any agreement for services is solely between you and that business. Home Guild Utah does not guarantee the availability, pricing, or performance of any member.

Intellectual property

The Home Guild Utah name, logo, and Certified Pro badge are the property of Home Guild Utah and may be used only by approved members in good standing, in accordance with the Guild's brand guidelines. The visual identity is used with permission of CT Home Guild.

Changes

We may update these terms at any time by posting a revised version here.

Governing law

These terms are governed by the laws of the State of Utah.

$10,000 Homeowner Guarantee Terms

1. The Guarantee

Subject to these terms, Home Guild Utah (the "Guild") guarantees that if an active Guild member (a "Member") commits a Default on a covered project, the Guild will, at its sole election, (i) arrange completion of unfinished work, (ii) arrange repair or replacement of defective work, or (iii) provide financial compensation for damage directly caused by the Default, up to a maximum of $10,000 per project. A "Default" means the Member's material failure to complete the labor described in an executed written Statement of Work, or labor that materially fails to conform to it.

2. Eligibility

  • You registered as a homeowner on homeguildutah.org before work began on the project.
  • You are at least 18 years old and the legal owner of the residential property where the work is performed.
  • The Member was an active, listed Guild member at the time you engaged them, and the property is within the Member's Guild service area.
  • You executed a written Statement of Work directly with the Member that describes the scope, price, and materials.

3. What is covered

Labor and non-defective goods associated with services performed by the Member under the Statement of Work.

4. What is not covered

  • Product or material defects, which are subject to the manufacturer's warranty.
  • Commercial projects, and work performed by third parties or subcontractors engaged directly by you.
  • Additional work not expressly documented in the executed Statement of Work, including verbal agreements and undocumented change orders.
  • Defects arising from force majeure events, vandalism, negligence of third parties, unpermitted construction, normal wear and tear, seasonal shifts, or your own interference or modification of the work.
  • Claims submitted more than sixty (60) days after the documented completion date.
  • Indirect, consequential, or incidental damages, and any amount above $10,000 or above the contract price.

5. Claim process

  1. You must first notify the Member in writing and give the Member a reasonable opportunity to remediate.
  2. If unresolved, submit a Notice of Default to the Guild through the contact form or by mail to the address below no later than sixty (60) days following the documented completion date, including the executed Statement of Work, proof of all payments made, and supporting documentation (photographs, correspondence, inspection reports).
  3. You agree to provide the Guild and its designees full, timely access to the project site for inspection, to cooperate in good faith with the Member and the Guild, and to keep the site in substantially the same condition as at the time of the claim.
  4. The Guild will determine in good faith whether a Default occurred and, if so, elect the remedy under Section 1.

6. Voidance

The Guarantee is void if you provided false or misleading documentation, refused or unreasonably delayed site access, engaged unauthorized third parties to alter the work before the claim was resolved, initiated legal or administrative proceedings against the Member before exhausting this process, or if the project involved stop-work orders or permit violations caused by you.

7. Subrogation

Upon any payment or remedy under the Guarantee, the Guild is subrogated to all rights, claims, and remedies you have against the Member to the extent of the payment, and you agree to execute documents reasonably necessary to effect that transfer.

8. Nature of the Guarantee

The Guarantee is not a performance bond, insurance policy, or unlimited warranty. It is a discretionary, limited, and conditional undertaking of the Guild governed by these terms. Any taxes applicable to compensation are your responsibility. The Guild may amend these terms prospectively by posting a revised version; the terms in effect on the date your project's Statement of Work was executed apply to that project.

9. Disputes

Any dispute about the Guarantee will first be the subject of good-faith negotiation for thirty (30) days after written notice. Unresolved disputes will be resolved on an individual basis under the laws of the State of Utah in the state or federal courts located in Salt Lake County, Utah.
